Terms of Service
These Terms of Service apply to the custom 3D printing and related services provided by Foggy Flow (the "Company"). Any individual or body using the Company's services is the "Customer".
1. Acceptance of terms
1.1 By browsing or using this website, the instant quote tool, the contact form or the AI chat assistant, or by making an enquiry, quote request or order through these channels, the Customer confirms that they have read, understood and agreed to be bound by these Terms of Service. If the Customer does not agree, please stop using this website and the Company's services.
2. The service
2.1 The Company makes pieces one at a time to order, in Hong Kong. The Customer describes the piece they want in the chat; the Company provides an artwork, then a 3D model. Nothing is printed until both the artwork and the 3D model have been approved by the Customer.
2.2 The Company charges nothing for the print until the Customer has seen the price. The price shown is the price the Customer pays.
2.3 The scope of work, deliverables and timetable are as agreed between the parties in the chat. The Customer must provide accurate and complete information, files and feedback in good time so that the Company can proceed smoothly.
3. Credits
3.1 Credits pay for drawing the artwork and making the 3D model. New customers receive the free credits shown in the chat.
3.2 The Customer's own STL file uses no credits; only the print is charged.
3.3 Credits used on an artwork or model the Customer has approved are not refunded.
4. Prices and payment
4.1 All prices are quoted in HKD. The minimum charge for an order is 68 HKD. Postage is included; see the Shipping Policy.
4.2 The Company accepts payment by credit card, Apple Pay or Google Pay through Airwallex, or by FPS or PayMe transfer.
4.3 The Company arranges production only after confirming receipt of the Customer's payment.
5. Delivery
5.1 Production time, postage and delivery arrangements are governed by the Company's Shipping Policy.
6. Content supplied by the Customer, and warranty
6.1 By using the Company's service, the Customer warrants that the work contains no text, image, design, trademark, currency or banknote, or any other copyright work included without the copyright owner's authorisation; that the work will not infringe any third-party right, including copyright, trademark, publicity or privacy, and will not defame or disparage any third party; that all authorisations or permissions needed to include third-party material in the work have been obtained; that the Customer holds all permissions, rights and authorisations needed to place the order and authorises the Company to make the work; and that, if the Company asks, the Customer will produce written proof of those permissions.
7. Content the Company does not make
7.1 The Company does not copy famous characters, team badges, a real person's face, or another company's trademark.
7.2 The Customer's own company name or logo may be added to a work only after the Customer confirms in the chat that they own the mark or are authorised to use it, and agrees to these terms.
8. Refusal and final decision
8.1 If content supplied by the Customer involves or may involve defamation, privacy infringement, counterfeiting, plagiarism, copying, intellectual-property infringement, indecency, obscenity, infringement of any third-party right, currency or banknotes, or a breach of the laws of Hong Kong, the Company reserves the right to refuse production. To the fullest extent permitted by applicable law, the Company accepts no liability for the content of the work to any user or third party.
8.2 The Company has the final say on whether any work is printed or produced.
9. Intellectual property
9.1 Text, photographs, images, designs and other material supplied by the Customer remain the property of the Customer or the original rights holder. The Customer grants the Company the licence needed to use that material to make, print and deliver the order.
9.2 The intellectual property in the artwork drawn and the 3D files made for an order is assigned or licensed to the Customer, in the scope agreed between the parties, once the relevant charges are paid in full.
9.3 The Company will not display, promote or use the Customer's work in a portfolio without the Customer's prior written consent.
10. Limits of the material and of hand-making
10.1 Clear resin is hard but brittle. The pieces are ornaments, not toys and not tools.
10.2 A model made from a photograph of a person shows a general likeness only, not an exact portrait.
10.3 The Company's pieces are made by hand, one at a time. Minor imperfections are a normal part of hand-making.
10.4 The colour seen on screen may differ from the piece itself; the piece itself is the standard.
11. Cancellation, returns and refunds
11.1 Cancellation, returns and refunds are governed by the Company's Refund and Cancellation Policy.
12. Limitation of liability
12.1 This website and its content are provided "as is". To the fullest extent permitted by Hong Kong law, the Company accepts no liability for any indirect, incidental or consequential loss arising from use of, or inability to use, this website, the service or any related content. Nothing in these terms excludes or limits any liability that cannot be excluded or limited at law.
13. Indemnity
13.1 The Customer undertakes that if any person, group or body brings any claim, notice or action concerning (i) the Customer's breach of these Terms of Service; or (ii) any text, photograph, image, graphic or other material in a product the Customer asks the Company to make that involves or may involve defamation, privacy infringement, counterfeiting, plagiarism, copying, intellectual-property infringement, indecency, obscenity, infringement of any third-party right, currency or banknotes, or a breach of the laws of Hong Kong, the Customer will indemnify the Company and its directors, management and staff against any loss suffered, including but not limited to related claims, losses, costs and reasonable legal fees.
14. Privacy
14.1 The Company handles personal data as set out in its Privacy Policy.
15. Third-party services
15.1 The service involves services provided by third parties, including payment processing (Airwallex, Shopify and others), AI services that draw artwork and make models, messaging apps and courier companies. The Company accepts no responsibility for the content, policies or practices of those third parties; the Customer uses them at their own risk.
16. Changes to these terms
16.1 The Company may revise these terms from time to time. Revised terms will be published on the Company's website and take effect from the "last updated" date shown at the top of the page. The Customer's continued use of this website and the service after an update constitutes acceptance of the revised terms.
17. Governing law
17.1 These terms are governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region. Any dispute arising from these terms or this website is subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
Shipping Policy
1. Production time
1.1 From the moment the Company confirms receipt of the Customer's payment, printing takes 2 days or more.
2. Postage and dispatch
2.1 Postage is included; delivery depends on where the Customer is. The Company posts from Hong Kong.
3. Delivery
3.1 The Company cannot guarantee a delivery date or a day of the week.
3.2 The logistics company will send the goods as quickly as it can. The Company accepts no liability for delays caused by traffic, weather or sudden incidents, and the Customer may not claim against the Company or return goods on that ground.
3.3 If the Customer's order must arrive by a certain date, please tell the Company before paying. The Company will do its best to arrange it.
Refund and Cancellation Policy
1. Cancelling an order
1.1 Before printing starts, the Customer may cancel the order, and the Company will refund the print fee the Customer has paid, less a handling charge of 2% of the order amount for the payment platform's fees.
1.2 Once a piece is on the plate it cannot be cancelled, because it is made for the Customer alone.
2. Imperfections, damage and mismatch with the model
2.1 The Company's pieces are made by hand, one at a time. Minor imperfections (such as slight texture, sanding marks or slight colour differences) are a normal part of hand-making and do not justify a return or refund.
2.2 If a piece arrives damaged, or is not the model the Customer approved, the Customer must send photographs to the Company within 7 days of receiving it. The Company will reprint the piece or refund the print fee.
2.3 A return or exchange covers a reprint of the same piece only; it is not a reason to change the style, content, specification or size.
3. Credits
3.1 Credits used on an artwork or model the Customer has approved are not refunded.
3.2 The Company has set up a review system: if an artwork or model differs greatly from what the Customer described, customer service will refund the relevant credits.
4. Scope of claims
4.1 For any claim on an order, the Company accepts only reprinting or refunding the relevant print fee. The Company accepts no liability for any economic loss of the Customer.
5. Refund arrangements
5.1 Refunds are completed within 7 working days.
5.2 Refunds are returned by the Customer's original payment method: for payments by credit card, Apple Pay or Google Pay through Airwallex, back to the original card or wallet; for FPS or PayMe transfers, by FPS transfer.
Privacy Policy
1. Data collected
The Company keeps: the Customer's chat name and chat ID, what the Customer tells the Company about the order, the Customer's orders, and the Customer's payment records.
2. Use of the data
The data above is used for: drawing artwork and making 3D models, processing and delivering orders, collecting payment and making refunds, accounting records, and answering the Customer's questions about past orders.
3. Disclosure to others
3.1 The Company does not sell the Customer's data.
3.2 The Company sends artwork or a description to the AI services that draw and build the model, and nowhere else for that purpose.
3.3 If the Customer pays by credit card, Apple Pay or Google Pay, payment takes place on a payment page of Airwallex or Shopify. That page collects what it asks for, such as the Customer's name and email, and the card is handled by its payment processor. The Company never sees the Customer's card number.
4. Retention and deletion
4.1 After 30 days, the Company deletes the photos the Customer sent, the artwork the Company drew, and the 3D files made for that order.
4.2 The conversation, the order records and the payment records are kept, because the Company needs them for accounting and to answer questions about past orders.
5. Rights of access and deletion
5.1 The Customer may ask in the chat at any time what data the Company holds, or ask the Company to delete files it still keeps.
5.2 Under the Personal Data (Privacy) Ordinance of Hong Kong, the Customer has the right to request access to and correction of the personal data the Company holds.
